Terms & Conditions

1. Parties

These Terms & Conditions (“Terms”) form a binding agreement between you (“Client”, “you”) and Vizible, operated by Arvind Singh (sole proprietorship), Bangalore, Karnataka, India (“Vizible”, “we”, “us”). By requesting a demo, creating an account, or subscribing to any Vizible plan, you accept these Terms in full.

2. Services

Vizible offers:

• Free Demo: A production-grade demo website built using publicly available data about your business, delivered at no cost and with no obligation.
• Starter Plan (₹5,000/year): A live website on your custom domain including services pages, gallery, enquiry form, Google Maps, and WhatsApp button.
• Full Platform (₹2,999/month): Everything in Starter plus AI chatbot, online booking, CRM, billing, inventory management, and staff scheduling.
• Enterprise: Custom pricing for businesses with 5+ locations. Contact us for a quote.

3. Free Demo

The demo website is provided entirely free of charge. It is built using publicly available information (business name, phone, rating, address, category). You have no obligation to purchase any plan after viewing your demo. We reserve the right to take demos offline if they are not converted to a paid subscription within 90 days of delivery.

4. Subscriptions & Payment

• Starter plan billing is annual (₹5,000/year). Full Platform billing is monthly (₹2,999/month). Both renew automatically unless cancelled before the renewal date.
• Payment is collected via Razorpay (UPI, cards, net banking). During our early phase prior to Razorpay activation, payment is collected manually after confirmation via WhatsApp.
• You will receive a reminder 7 days before each renewal. Failure to pay within 5 days of the due date will result in suspension of the website; failure to pay within 30 days will result in termination.
• All prices are inclusive of applicable taxes unless stated otherwise.

5. Cancellation

You may cancel your subscription at any time by contacting us via WhatsApp or email. Cancellation takes effect at the end of the current billing period. Your website remains live until then. After cancellation, your website is taken offline and your data is retained for 30 days before deletion, unless you request earlier deletion.

6. Content & Intellectual Property

• Your content: You retain ownership of all content you provide (business name, logo, photos, descriptions). You grant Vizible a non-exclusive licence to use this content solely to deliver the Services.
• Vizible's work: The website design, code, templates, and platform tooling created by Vizible remain the intellectual property of Vizible. Upon cancellation or non-renewal, your licence to use these designs ends.
• Footer credit:All websites built by Vizible carry a small “Built by Vizible” footer credit. This may be removed upon request at no charge.

7. Client Obligations

You agree to:

• Provide accurate business information when requested.
• Not use Vizible's services for any unlawful purpose.
• Not attempt to reverse-engineer, copy, or resell Vizible's platform or templates.
• Ensure you hold the rights to any photos or content you provide for your website.

8. Availability & Uptime

Vizible targets 99.9% uptime for hosted websites. Hosting is provided via Vercel's global CDN. Planned maintenance is communicated in advance. Vizible is not responsible for outages caused by Vercel, DNS providers, or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Vizible's total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount paid by you in the 12 months preceding the claim. Vizible is not liable for indirect, incidental, special, or consequential damages, including loss of revenue or business opportunities.

10. Indemnification

You agree to indemnify and hold Vizible harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved amicably. If unresolved within 30 days, disputes are subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.

12. Changes to Terms

We may update these Terms at any time. Active subscribers will be notified via email at least 14 days before material changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
